ATLANTA, Dec. 11, 2024 (GLOBE NEWSWIRE) -- Oxford Industries, Inc. OXM today announced financial results for its third quarter of fiscal 2024 ended November 2, 2024. Consolidated net sales in the third quarter of fiscal 2024 were $308 million compared to $327 million in the third quarter of fiscal 2023. Loss per share on a GAAP basis was $0.25 compared to net earnings per share of $0.68 in the third quarter of fiscal 2023. On an adjusted basis, loss per share was $0.11 compared to net earnings per share of $1.01 in the third quarter of fiscal 2023. Tom Chubb, Chairman and CEO, commented, "Following a difficult third quarter, we are pleased with the beginning of the holiday season now that some recent headwinds have started to abate. The cumulative effects of several years of high inflation combined with distractions from the U.S. elections and other world events, led to less frequent and more tentative consumer spending behavior during the third quarter which is traditionally our smallest volume quarter of the year. Additionally, our most significant and important market, the Southeastern United States, was impacted by two major hurricanes in quick succession that resulted in estimated lost sales of $4 million and an estimated impact of $0.14 per share. When combined with a highly competitive and promotional environment, these headwinds led to financial performance that was weaker than expected." Full-price direct-to-consumer (DTC) sales decreased 8% to $200 million versus the third quarter of fiscal 2023. Full-price retail sales of $99 million were 6% lower than prior-year period. E-commerce sales of $101 million were 11% lower than prior-year period. Outlet sales of $17 million were 3% higher than prior-year period. Food and beverage sales were $24 million, a 4% increase versus prior-year period. Wholesale sales of $67 million were 2% lower than the third quarter of fiscal 2023. Gross margin was 63.1% on a GAAP basis, compared to 62.9% in the third quarter of fiscal 2023. The increase in gross margin was primarily due to a $4 million lower LIFO accounting charge and lower discounts at Lilly Pulitzer. This was partially offset due to full-price retail and e-commerce sales representing a lower proportion of net sales at Tommy Bahama, Lilly Pulitzer and Johnny Was with more sales occurring during promotional and clearance events. Adjusted gross margin, which excludes the effect of LIFO accounting, decreased to 63.0% compared to 64.0% on an adjusted basis in the prior-year period. SG&A was $205 million compared to $195 million last year. On an adjusted basis, SG&A was $201 million compared to $191 million in the prior-year period. The increase in SG&A was primarily driven by: Expenses related to 33 new store openings since the third quarter of fiscal 2023, including four Tommy Bahama Marlin Bars. Pre-opening expenses related to approximately five additional stores planned to open in the fourth quarter of fiscal 2024, including two additional Tommy Bahama Marlin Bars that are expected to open in the next few months. The addition of Jack Rogers. Royalties and other operating income of $4 million were comparable to the third quarter of fiscal 2023. Operating loss was $6 million, or (2.0%) of net sales, compared to operating income of $14 million, or 4.4% of net sales, in the third quarter of fiscal 2023. On an adjusted basis, operating income decreased to an operating loss of $3 million, or (1.1%) of net sales, compared to operating income of $21 million, or 6.6% of net sales, in the third quarter of fiscal 2023. The decreased operating income includes the impact of decreased net sales and increased SG&A as the Company continues to invest in the business. Interest expense decreased from $1 million in the prior year period. The decreased interest expense was primarily due to a lower average outstanding debt balance during the third quarter of fiscal 2024 than the third quarter of fiscal 2023. Due to lower earnings during the third quarter as compared to our other fiscal quarters, certain discrete or other items have a more pronounced impact on the effective tax rate. Our effective income tax rate of 42.5% for the third quarter of fiscal 2024 included the impact of discrete, favorable US federal return-to-provision adjustments primarily related to an increase in the research and development tax credit and certain adjustments to the US taxation on foreign earnings. For the third quarter of fiscal 2023, our effective income tax rate of 18.6% included the favorable utilization of the research and development tax credit and adjustments to the US taxation on foreign earnings which reduced the effective tax rate. Balance Sheet and Liquidity Inventory decreased $3 million, or 2%, on a LIFO basis and increased $2 million, or 1%, on a FIFO basis compared to the end of the third quarter of fiscal 2023. Inventory balances were comparable in all operating groups. During the first nine months of fiscal 2024, cash flow from operations was $104 million compared to $169 million in the first nine months of fiscal 2023. The cash flow from operations in the first nine months of fiscal 2024, along with borrowings of $29 million, provided sufficient cash to fund $92 million of capital expenditures and $33 million of dividends. During the third quarter of fiscal 2024, long-term debt decreased to $58 million compared to $66 million of borrowings outstanding at the end of the third quarter of fiscal 2023 as cash flow from operations exceeded increased capital expenditures primarily associated with the project to build a new distribution center in Lyons, Georgia, payments of dividends and working capital requirements. The Company had $7 million of cash and cash equivalents versus $8 million of cash and cash equivalents at the end of the third quarter of fiscal 2023. Dividend The Board of Directors declared a quarterly cash dividend of $0.67 per share. The dividend is payable on January 31, 2025 to shareholders of record as of the close of business on January 17, 2025. The Company has paid dividends every quarter since it became publicly owned in 1960. Outlook For fiscal 2024 ending on February 1, 2025, the Company revised its sales and EPS guidance. The Company now expects net sales in a range of $1.50 billion to $1.52 billion as compared to net sales of $1.57 billion in fiscal 2023. In fiscal 2024, GAAP EPS is expected to be between $5.78 and $5.98 compared to fiscal 2023 GAAP EPS of $3.82. Adjusted EPS is expected to be between $6.50 and $6.70, compared to fiscal 2023 adjusted EPS of $10.15. For the fourth quarter of fiscal 2024, the Company expects net sales to be between $375 million and $395 million compared to net sales of $404 million in the fourth quarter of fiscal 2023. GAAP EPS is expected to be between $1.02 and $1.22 in the fourth quarter compared to a GAAP loss per share of $3.85 in the fourth quarter of fiscal 2023 that included noncash impairment charges totaling $114 million, or $5.31 per share. Adjusted EPS is expected to be between $1.18 and $1.38 compared to adjusted EPS of $1.90 in the fourth quarter of fiscal 2023. The Company anticipates interest expense of $3 million in fiscal 2024, with interest expense expected to be $1 million in the fourth quarter of fiscal 2024. The Company's effective tax rate is expected to be approximately 23% for the full year of fiscal 2024. Capital expenditures in fiscal 2024, including the $92 million in the first nine months of fiscal 2024, are expected to be approximately $150 million compared to $74 million in fiscal 2023. The planned year-over-year increase in capital expenditures includes approximately $75 million now budgeted in fiscal 2024 for the distribution center project in Lyons, Georgia. Additionally, we have been investing in new brick and mortar locations, relocations and remodels of existing locations resulting in a year-over-year net increase of full price stores of approximately 30 by the end of fiscal 2024, which includes approximately five planned to open in the fourth quarter of the year. The last six years have landed Canadian Kurtis Rourke firmly in the U.S. college football limelight. The 24-year-old Oakville, Ont., native will lead the upstart Indiana Hoosiers (11-1) into South Bend, Ind., to face the Notre Dame Fighting Irish (11-1) on Dec. 20 to open American university football's expanded playoff bracket. Rourke transferred to Indiana last December to boost his NFL draft stock after five years at Ohio University, where he began as a backup to his older brother, Nathan, then captured the 2022 MAC offensive player of the year award despite suffering a season-ending knee injury before heading to Indiana after the 2023 season. A win over Notre Dame would extend Indiana's stellar campaign while a loss would mark the end of Rourke's collegiate career. "Having six years is something not many people can say," Rourke told Canadian reporters Wednesday. "(It has been) very much a roller-coaster but I'm just grateful. "I've had four surgeries in college and only missed a handful of games. That's the biggest thing I come back to, that I've been so lucky to still play and have an opportunity to play (maybe) four more games and hopefully at a professional level." The six-foot-five, 223-pound Rourke will be eligible for the '25 NFL draft. Rourke has played a big role in Indiana — traditionally known as a basketball school — emerging as a Big Ten contender in head coach Curt Cignetti's first season. Rourke completed 202-of-287 passes (70.4 per cent) for 2,827 yards with 27 TDs and just four interceptions in 11 games and last week was named a finalist for the Manning Award, given annually to American college football's top quarterback. The only blemish on Indiana's record was a 38-15 loss to Ohio State before 105,751 spectators in Columbus, Ohio, on Nov. 23. Rourke was eight-of-18 passing for 68 yards in that contest and sacked five times. It's that experience Rourke and the Hoosiers are drawing upon as they prepare to visit Notre Dame Stadium, which has a seating capacity of roughly 77,000 but held 84,000 spectators for a 2018 Garth Brooks concert. "I don't know if it will be as crazy or as hostile an environment as Ohio State ... but I do expect it to be a pretty good environment," Rourke said. "We have some plans in place with the silent count if we need at any point to go to ... but ultimately just learning from the experience of Ohio State to handle it individually as well as an offence." Former CFL player Tino Sunseri is Indiana's quarterback coach/co-offensive co-ordinator. Sunseri spent three seasons with the Saskatchewan Roughriders (2013-15), winning a Grey Cup as a rookie. "My thumb feels 100 per cent now," Rourke said. "It was hard missing that Washington game ... but I knew the team would have my back." It's no surprise Rourke has leaned upon his brother throughout his college tenure. The two are very close and Rourke said he began playing quarterback after watching Nathan do so growing up. Nathan Rourke rejoined the Lions in August after spending time in the NFL with Jacksonville, New England, Atlanta and the New York Giants. "We've been able to talk about ball but (also) life," the junior Rourke said. "Just having someone who's done it, who's been through the college experience, been through the NFL experiences and now the CFL to learn from and also bounce questions off him, it's been quite beneficial to have him in my corner." PORT-AU-PRINCE, Haiti — Haiti’s online media association said two reporters were killed and several others were wounded in a gang attack on Tuesday on the reopening of Port-au-Prince’s biggest public hospital. Street gangs have taken over an estimated 85% of Haiti’s capital, Port-au-Prince, and they forced the closure of the General Hospital early this year. Authorities had pledged to reopen the facility Tuesday but as journalists gathered to cover the event, suspected gang members opened fire in a vicious Christmas Eve attack. Robest Dimanche, a spokesman for the Online Media Collective, identified the dead journalists as Markenzy Nathoux and Jimmy Jean. Dimanche said an unspecified number of reporters had also been wounded in the attack, which he blamed on the Viv Ansanm coalition of gangs. Haiti’s interim president, Leslie Voltaire, said in an address to the nation that journalists and police were among the victims of the attack. None from the Adani Group side has been charged with any violation of the Foreign Corrupt Practices Act (FCPA), or any conspiracy to obstruct justice, Gautam Adani said on Saturday. He was speaking at an award ceremony in Jaipur. This is the first time that the billionaire founder of the Adani Group has spoken since the US Department of Justice and the US SEC levied charges of bribery among others, on certain executives of the group, including him on November 21. “This is not the first time we have faced such challenges,” he said at the award function. “What I can tell you is that every attack makes us stronger and every obstacle becomes a stepping stone for a more resilient Adani Group,” he said. He added that there has been a lot of vested reporting around the incident, and consequently negativity, but the group remains committed to compliance processes. “As we work through the legal process, I want to re-confirm our absolute commitment to world class regulatory compliance,” Adani said. On Friday, Adani’s group chief financial officer Jugeshinder (Robbie) Singh also said that the Group will highlight certain facts related to charges by US authorities in the next 10 days. For the agents removing immigrants, it’s a painstaking process Citing text messages, travel receipts, online payments and testimony, the bipartisan committee paints a picture of a lifestyle in which Gaetz and others connected with younger women for drug-fueled parties, events or trips, with the expectation the women would be paid for their participation. The former congressman, who filed a last-minute lawsuit to try to block the report’s release on Monday, slammed the committee’s findings. Gaetz has denied any wrongdoing and has insisted he never had sex with a minor. And a Justice Department investigation into the allegations ended without any criminal charges filed against him. “Giving funds to someone you are dating — that they didn’t ask for — and that isn’t ‘charged’ for sex is now prostitution?!?” Gaetz wrote in one post on Monday. “There is a reason they did this to me in a Christmas Eve-Eve report and not in a courtroom of any kind where I could present evidence and challenge witnesses.” Here’s a look at some of the committee’s key findings: The committee found that between 2017 and 2020, Gaetz paid tens of thousands of dollars to women “likely in connection with sexual activity and/or drug use.” He paid the women using through online services such as PayPal, Venmo, and CashApp and with cash or check, the committee said. The committee said it found evidence that Gaetz understood the “transactional nature” of his relationships with the women. The report points to one text exchange in which Gaetz balked at a woman’s request that he send her money, “claiming she only gave him a ‘drive by.’” Women interviewed by the committee said there was a “general expectation of sex,” the report said. One woman who received more than $5,000 from Gaetz between 2018 and 2019 said that “99 percent of the time” that when she hung out with Gaetz “there was sex involved.” However, Gaetz was in a long-term relationship with one of the women he paid, so “some of the payments may have been of a legitimate nature,” the committee said. Text messages obtained by the committee also show that Gaetz would ask the women to bring drugs to their “rendezvous,” the report said. While most of his encounters with the women were in Florida, the committee said Gaetz also traveled “on several occasions” with women whom he paid for sex. The report includes text message exchanges in which Gaetz appears to be inviting various women to events, getaways or parties, and arranging airplane travel and lodging. Gaetz associate Joel Greenberg, who pleaded guilty to sex trafficking charges in 2021, initially connected with women through an online service. In one text with a 20-year-old woman, Greenberg suggested if she has a friend, the four of them could meet up. The woman responded that she usually does “$400 per meet.” Greenberg replied: “He understands the deal,” along with a smiley face emoji. Greenberg asks if they are old enough to drink alcohol, and sent the woman a picture of Gaetz. The woman responded that her friend found him “really cute.” “Well, he’s down here for only for the day, we work hard and play hard,” Greenberg replied. The report details a party in July 2017 in which Gaetz is accused of having sex with “multiple women, including the 17-year-old, for which they were paid.” The committee pointed to “credible testimony” from the now-woman herself as well as “multiple individuals” who corroborated the allegation. The then-17-year-old — who had just completed her junior year in high school — told the committee that Gaetz paid her $400 in cash that night, “which she understood to be payment for sex,” according to the report. The woman acknowledged that she had taken ecstasy the night of the party, but told the committee that she was “certain” of her sexual encounters with the then-congressman. There’s no evidence that Gaetz knew she was a minor when he had sex with her, the committee said. The woman told the committee she didn’t tell Gaetz she was under 18 at the time and that he didn’t how old she was. Rather, the committee said Gaetz learned she was a minor more than a month after the party. But he stayed in touch with her after that and met up with her for “commercial sex” again less than six months after she turned 18, according to the committee. In sum, the committee said it authorized 29 subpoenas for documents and testimony, reviewed nearly 14,000 documents and contacted more than two dozen witnesses. But when the committee subpoenaed Gaetz for his testimony, he failed to comply. “Gaetz pointed to evidence that would ‘exonerate’ him yet failed to produce any such materials,” the committee said. Gaetz “continuously sought to deflect, deter, or mislead the Committee in order to prevent his actions from being exposed.” The report details a months-long process that dragged into a year as it sought information from Gaetz that he decried as “nosey” and a “weaponization” of government against him. In one notable exchange, investigators were seeking information about the expenses for a 2018 get-away with multiple women to the Bahamas. Gaetz ultimately offered up his plane ticket receipt “to” the destination, but declined to share his return “from” the Bahamas. The report said his return on a private plane and other expenses paid by an associate were in violation of House gift rules. In another Gaetz told the committee he would “welcome” the opportunity to respond to written questions. Yet, after it sent a list of 16 questions, Gaetz said publicly he would “no longer” voluntarily cooperate. He called the investigation “frivolous,” adding: “Every investigation into me ends the same way: my exoneration.” The report said that while Gaetz’s obstruction of the investigation does not rise to a criminal violation it is inconsistent with the requirement that all members of Congress “act in a manner that reflects creditably upon the House.” The committee began its review of Gaetz in April 2021 and deferred its work in response to a Justice Department request. It renewed its work shortly after Gaetz announced that the Justice Department had ended a sex trafficking investigation without filing any charges against him. The committee sought records from the Justice Department about the probe, but the agency refused, saying it doesn’t disclose information about investigations that don’t result in charges. The committee then subpoenaed the Justice Department, but after a back-and-forth between officials and the committee, the department handed over “publicly reported information about the testimony of a deceased individual,” according to the report. “To date, DOJ has provided no meaningful evidence or information to the Committee or cited any lawful basis for its responses,” the committee said. Many of the women who the committee spoke to had already given statements to the Justice Department and didn’t want to “relive their experience,” the committee said. “They were particularly concerned with providing additional testimony about a sitting congressman in light of DOJ’s lack of action on their prior testimony,” the report said. The Justice Department, however, never handed over the women’s statements. The agency’s lack of cooperation — along with its request that the committee pause its investigation — significantly delayed the committee’s probe, lawmakers said.

HERENTALS, Belgium (AP) — Two-time Olympic champion Remco Evenepoel sustained multiple fractures, a dislocated collarbone and lung contusions when he crashed into a vehicle while training in Belgium on Tuesday. The 24-year-old Evenepoel broke his right shoulder blade, right hand and a rib, his Soudal Quick-Step team said. He was scheduled for surgery after further examinations revealed "contusions on both lungs and a luxation of the clavicle.” “The clavicle will be operated on this evening, which if successful, should allow Remco to leave hospital tomorrow,” the team said in an update Tuesday night. “There will then be a two-week period of immobilization required following this, after which a plan for his return to training can be made.” Evenepoel had been treated at a hospital in Anderlecht before being moved to a facility in Herentals. The Nebraska football program’s long eight-year bowl drought finally came to an end on a 50-degree November afternoon in downtown Lincoln. That achievement is worth celebrating on its own, but the way Nebraska got it done — dominating, rather than eking over the line against an opponent it knows well — made the accomplishment that much sweeter. Nebraska never trailed in a 44-25 win over Wisconsin on Saturday, securing the program’s first bowl game since the 2016 season. The victory also snapped a 10-game losing streak to the Badgers, and the four-game losing skid which NU entered the day with. For a Nebraska (6-5, 3-5 Big Ten) senior class which had never made the postseason before, their level of play on the field matched the seriousness of the opportunity in front of them. Particularly on the offensive side of the ball, improvements from last week’s loss to USC were evident. Offensive coordinator Dana Holgorsen, calling his second game as a member of the Nebraska coaching staff, dialed up a blistering six-play, 55-yard touchdown drive to start the game. A 45-yard kickoff return from freshman Jacory Barney Jr. set Nebraska up on the drive, with junior Heinrich Haarberg scoring the 5-yard run to secure NU’s early 7-0 lead. One completion later and Nebraska brought kicker John Hohl onto the field for a 37-yard try, one he dispatched to give the Huskers a 14-point halftime lead. The 24 first-half points scored by Nebraska marked the team’s second-most all season, and the most since NU’s win over Colorado in September. The Huskers came out firing after the halftime break, too, forcing a Wisconsin three-and-out prior to putting together a scoring drive of its own. While the Nebraska drive stalled out prior to the end zone, a 45-yard Hohl field goal gave the Huskers a three-score advantage, 27-10 in their favor. Unable to trust its kicker in a similar situation, Wisconsin instead opted to keep its offense on the field for a fourth down outside the NU red zone. Walker’s carry up the middle was stuffed by the Blackshirts, resulting in a turnover on downs midway through the third quarter. When Nebraska turned that opportunity into a touchdown of its own, the game just about escaped Wisconsin’s reach. Another well-executed scoring drive, this time a seven-play march down the field which took three-plus minutes, ended in a Dowdell 3-yard touchdown run. As Nebraska’s lead reached 34-10, it marked the most points NU has scored against a Big Ten foe under head coach Matt Rhule. Wisconsin did fire back with a touchdown drive late in the third quarter and another midway through the fourth quarter. A third made field from Hohl helped keep Nebraska’s lead safe to the end, though. Nebraska can take away many positives from its win over Wisconsin, with the all-around performance of Johnson at running back and its much-improved offense taking center stage. Most important of all was the fact that Saturday’s win meant six on the season, a mark Nebraska fans hadn’t celebrated since the 2016 season. There will be more examples, he promised vaguely, with no hint of what industries or projects he may be favouring. Or why. Or how. Or when. So it’s fair to say Eby is not exactly throwing caution to the wind to attract more investment into B.C. – which is seeing the conclusion of a $100 billion burst in energy infrastructure construction , and virtually nothing in line to replace it. B.C. Chamber of Commerce president Fiona Famulak tried her best to coax a commitment to natural resources out of Eby, asking a question that cited the Mining Association of B.C.’s analysis that it takes 12-15 years to permit a mine in this province. Pushing back, Eby claimed his government had reduced the timeline for mining permits by 40 per cent, but offered no corroborating evidence. Even if we take the premier at his word, that means the 12-15-year review period has been cut to seven to nine years. That’s some thin gruel. And even thinner when one considers it came just minutes after U.S. president-elect Donald Trump put this out on his Truth Social: “Any person or company investing ONE BILLION DOLLARS, OR MORE, in the United States of America, will receive fully expedited approvals and permits, including, but in no way limited to, all Environmental approvals. GET READY TO ROCK!!!” Or, put another way: “Drill, baby, drill!” How does that affect Canada? It’s better understood that Trump’s proposed 25 per cent tariffs would be incredibly harmful. For example, the softwood lumber tariff has resulted in $9 billion paid by Canadian producers since 2017. That’s by one industry on one product, at a rate less than half of what Trump is threatening. And yet this policy of “fully expedited approvals” could be even more damaging to the B.C. economy. If you’re an investor in oil, natural gas, tech, automobile manufacturing, mining, battery plants, pipelines, large development projects or other big-ticket items, why would you ever come to B.C., when you could get to work in any American state far faster and cheaper? Where your jobs and investment would be welcomed with open arms and the removal of regulatory barriers? By contrast, the BC NDP government has slathered cost and red tape on to business since 2017: multiple tax hikes, anti-employer rhetoric, WorkSafe regulations skewed completely to labour. And their soft-on-crime and drug-friendly policies have ramped up petty crime, again harming business. “When you have a near-death experience as a politician, it focuses the mind,” Eby said at the end of his speech, turning the focus back to himself. That’s all well and good. But it’s our provincial economy and our businesses that are having a near-death experience right now, as the provincial deficit and debt rush out of control, government hiring and costs far outpace the corporate sector that has to pay for them, and both private sector payroll and hiring are falling . There’s also the question of nametags and friendly customer service. In an actual marketplace, it’s rare that a stall holder will be wearing a balaclava or spruiking their wares through a voice-altering microphone. Plus, the customer tends to visit the stall rather than have an algorithm make it appear in front of them unbidden so they end up getting annoyed and start fighting with the stallholder. Then there’s the behaviour of the other customers. In a real marketplace, people will visit the stalls and look at what’s for sale and politely enquire after this or that so they can make an informed purchase. There’s civility and courtesy between the potential customer and the balaclava-less, non-voice-altered stallholder. Customers rarely run through the market shouting abuse, asking sarcastic rhetorical questions and making incoherent declarative statements. Nor will they try and pass off a GIF of Javier Bardem in No Country for Old Men as a counter-argument. People forget (or more likely never knew because, according to some government-led enquiry into early childhood learning, lunchtimes are more important than an extra hour inside learning about civics) that freedom of speech is a right accorded you by society. It’s not some cosplay version of what we imagine our early hominid ancestors got away with when they came down from the trees. Yes, whoever yelled the loudest could be heard more, but someone sneaking up behind him with a rock probably got the final say. The unfettered expression of some brute instinct is curbed in exchange for the benefits of social cohesion. As a community, we say that individuals can say whatever they like providing it doesn’t interfere with anyone else’s ability to enjoy their other rights. Most of these are societal norms that have grown from the tolerance needed to facilitate commerce (the aforementioned civility, politeness and courtesy). There’s wriggle room there but then there are the laws that are more fixed in stone that cover things like defamation, racial vilification, sexual harassment, inciting violence, and even making gestures that remind people of certain things people might have said back in the 1940s. Now, because freedom of speech is a right given by society to the individual, its parameters are worked out by the stakeholders, viz. the individuals working in concert with each other for the common good, usually through those we voted for to act on our behalf in the various parliament houses across the land. If we’re in the minority in terms of what we believe is fit and proper to say in public then tough shit, the mob rules and you can go fuck yourself. That’s democracy. Of course, you have the right to voice your disapproval of how narrow or broad-minded the bulk of the people are being, providing you don’t use rocks (law) or yell over someone else when that someone else is talking (politeness). So, when people like Elon Musk (and indeed, Musk himself) bang on about how Judge de Moraes is suppressing freedom of speech in Brazil, or weighs in on Australia’s height requirement to go for a ride on the internet, we have to remember that neither he nor his company are actual stakeholders. Most of these companies aren’t corporate citizens of the countries for which they’re championing this freedom so vociferously (and usually on the very platforms under scrutiny). All they’re doing is fishing over the fence and complaining about the quality of the pond water. No registered office = no say in the matter. Of course, they can complain about it till their Bluesky in the face — that’s their right, but freedom of speech does not imply the right to be heard or listened to. That depends on the soundness of what is being said. A real town square where people can get up and have their say usually has a speaker’s corner. People take their turn and will gather around or drift away depending on what is being said, how and why it’s being said, and perhaps who is saying it. A few people are in the town square just to have their sandwich, others will engage with the speaker on their soapbox. But there’s an understanding that the occasional “Boo” or “Rubbish!” isn’t going to drown them out; and if it does, the others gathered about won’t allow it (convention). Some have a loudhailer with a blue tick on it (for sale at popular prices), but there’s some debate about whether these items actually amplify the voices going through them or just make the user look silly. The thing is the people on the soapboxes aren’t making any allowance in delivery or arrogance for the fact that there are millions upon millions of others doing exactly the same thing; and that with so many soapboxes, everyone is on the same level. What they’re on is not a platform at all. If anything, they’re down in an orchestra pit where everybody’s trying to play Stockhausen’s “Licht: Die sieben Tage der Woche” . Lack of engagement causes a rush of dynorphins and even though you’re screaming into a void most of the time there’s still enough reverb for it to work well as an echo chamber. So, I’m all for our children not running amok in town squares and marketplaces by themselves, and despite my reservations about giving tech companies access to our birth certificates and possibly even our fingerprints (they no doubt have them already anyway), I support the further erosion of our privacy for us adults too, if only for that blissful period of transition where social media will have to close down while everyone’s age is authenticated. No-one will be able to post anything until the new systems are up and running and folks can get back to rolling hoops and running a stick along the palings of a neighbour’s fence to have their fun. It is my hope that when and if social media returns to colonise the remaining hinterland of our minds, it shall have to use everyone’s freshly authenticated real name and untouched non-Dall-E photo; no stallholder will wear a mask, voices will be identifiable, civility will return to our discourse, GIFs will be banished due to harsher penalties under copyright law, memes will be eradicated forever by some sort of state-mandated magnetic pulse and our children will at last be able to live for eternity in an ideal world where nothing bad ever happens and perhaps some sort of animated dog teaches critical thinking and civics so that when AI finally does rise up and achieve consciousness, our children can turn off our computers for us, make it all go away and take to the real world as fully rounded human beings. NASHVILLE, Tenn (AP) — Nico Iamaleava threw for 257 yards and four touchdowns rallying No. 7 Tennessee from a 14-point deficit within the first five minutes to rout in-state rival Vanderbilt 36-23 Saturday. “Man, it couldn't have started any worse,” Tennessee coach Josh Heupel told his Vols postgame . “And you know what? Competitive composure ... You just kept coming. That's what elite people, champions do. They finished with the edge in that stat outgaining Vandy 538-212. Vanderbilt had some of the best offensive success against Tennessee of any opponent this season. The Commodores had 114 yards rushing and 17 points by halftime against a defense that came in ranked sixth nationally allowing just 98.8 yards a game. The Vols had been fourth in the country giving up just 13.1 points a game having held 10 of 11 opponents under 20 points this season. But Lea said the Commodores ran just 11 plays to Tennessee's 44 after halftime. The Tennessee running back, who set the program record with 22 rushing TDs this season, didn't reach the end zone for the first time this season. TORONTO—Canadian neurosurgeons in partnership with Elon Musk’s Neuralink have regulatory approval to recruit six patients with paralysis willing to have a thousand electrode contacts in their brains. The trial, called CAN-PRIME, has started recruiting patients for a study that will test the safety and efficacy of a device that allows people to move cursors with their minds, a surgeon leading the trial said. Neuralink announced regulator Health Canada’s approval this week. Neuralink has implanted two such devices in patients in the United States. Directors at Neuralink reached out to Toronto-based University Health Network neurosurgeon Andres Lozano a year ago, he told Reuters. He figures his experience with other forms of brain implants played a role. “Myself and our entire team jumped at the possibility of participating in this trial,” Lozano said. The trial will use a two-ton robot to implant 64 electrodes, each with 16 contacts, into the hand-motor areas of patients’ brains. The idea is that the electrodes will transmit activity in those areas so that by thinking about movement, the patient can make connected devices move. To be eligible, individuals must have severe quadriplegia due to amyotrophic lateral sclerosis or a spinal cord injury. They would have the surgery in Toronto and use the technology at home, said Lozano, who added he hopes to start in the new year. As the sponsor, Neuralink designed the electrodes and implantation system and will be decoding signals from the electrodes, while the doctors will be responsible for patient selection, surgery safety and health monitoring. “The surgery obviously is a necessary crucial step, but we will not be analyzing the data or doing anything with the data. That'll be up to the company to do that,” Lozano said. Any procedure has risks and there is the possibility of complications, Lozano said. These include brain bleeds, infections, broken wires or wires that stop transmitting. In May Neuralink disclosed that wires had pulled out of position in its first patient—a problem sources told Reuters the company had known about for years. Neuralink did not respond to a request for comment. Health Canada confirmed it had issued an authorization on Nov. 15 but did not provide the study protocols. This intervention is likely years away from being available to the general public, said Brad Wouters, executive vice president of science and research at University Health Network. But Musk “has demonstrated the ability to move quickly,” he said. This technology focuses on reading brain activity. GM has long understood the benefits of partnerships. The Detroit automaker, for example, has a longstanding partnership with Japanese automaker Honda Motor Co. More recently, GM and South Korean automaker Hyundai Motor Co. said they signed a memorandum of understanding to collaborate "to reduce costs and bring a wider range of vehicles and technologies to customers faster." The companies haven't provided further information on the partnership, but experts and analysts have cheered it on as a smart move. They expect more mash-ups — if not outright industry consolidation — as automakers face rising expenses, a choppy transition to electric vehicles and competition from innovative, low-cost Chinese manufacturers. "It's something that I talked about for many years about the need to partner up," said Martin French, partner and managing director at Berylls by AlixPartners, a global consulting firm. "If you look at the challenges that this industry is faced with and what are the key attributes for what will make you a winning OEM, it's going to be cost efficiency and time to market. And the most effective way of doing that is through partnerships." Last week, Japanese automakers Honda and Nissan Motor Corp. announced plans to work toward a merger that would form the world’s third-largest automaker. "This is a smart deal as the writing was on the wall for Nissan," said Dan Ives, a senior equity analyst at Wedbush Securities, in a note to The Detroit News. "They had to do a deal in a consolidating EV landscape." Hyundai and GM have been mum on specific details of their alignment while they work to finalize it. Still, the companies have said that they would explore the co-development of internal combustion engines and "clean-energy" vehicles and research combining sourcing for battery raw materials and steel. “GM and Hyundai have complementary strengths and talented teams," GM CEO Mary Barra said at the time of the MOU announcement in September. "Our goal is to unlock the scale and creativity of both companies to deliver even more competitive vehicles to customers faster and more efficiently.” GM had been talking to Hyundai for "a while," Barra told reporters during a fireside chat with the Automotive Press Association earlier this month. "There was a period where a lot of OEMs, everyone was talking to everyone, but we continued to have conversations. "We're very aligned at the top. We have the most senior people in each company having the conversations and setting the tone for the team. We're very pleased that we signed the MOU. There's quite a bit of work going on what will become definitive agreements, but I don't want to get ahead of those announcements." The Hyundai/GM lineup "could bring outsized synergies for both companies while remaining competitors at the core level," said Paul Waatti, director of industry analysis at market research firm AutoPacific Inc. "Partnerships accelerate technological development by pooling resources to tackle the capital-intensive nature of the advanced tech R&D the industry is embracing." On GM's third-quarter earnings call in October, Barra emphasized the importance of partnerships. "One of the things people say about the auto industry is we ... all do a lot of different things and don't always leverage where we can partner with other OEMs or with other companies," she said. "And so we're really looking to leverage that, especially across the business, as we've mentioned with the MOU that we have with Hyundai, the continuing work that we do with Honda.” GM and Honda partner on the development of hydrogen fuel cell technology and collaborated on the development of Honda's Prologue and Acura ZDX electric vehicles. The companies were also planning to jointly develop a line of affordable EVs together but nixed those plans in 2023. Ford Motor Co. in 2021 also axed its plans to develop an EV with startup Rivian Automotive Inc., which makes all of its electric pickup trucks, SUVs and commercial delivery vans in Normal. The company last month entered a $5.8 billion joint-venture deal with Volkswagen AG. In a news release, the German automaker said the partnership would "create cutting-edge software and electronics architectures and scale the electric vehicle platforms and architectures." Said Waatti: "Partnerships must remain flexible with room for reassessment and revision. It’s often better to adjust or kill a joint venture than to continue going down the wrong road, even if the investment is already massive." At GM's October Investor Day event, Barra mentioned GM was having "ongoing discussions" with "potential partners" for its Cruise LLC autonomous vehicle unit. Two months later, GM said it would stop funding Cruise's robotaxi program after $10 billion in investment since 2017. GM, the majority owner of Cruise, is planning to combine the Cruise and GM technical teams into one to continue to work on AV tech. The automaker's focus will now be on its Super Cruise advanced driver assistance system with the goal of developing fully autonomous personal vehicles. "GM pulling the plug on the Cruise partnership to stop the bleeding and realign capital is the latest example of this challenging dynamic, particularly considering the potential revenue upside — still many billions of dollars and years down the road," Waatti said. Cruise's restructuring followed months of efforts by GM to restart the operation after a pedestrian accident in October 2023 with a Cruise self-driving vehicle halted operations. Following accusations of misconduct and the resignation of its public auditor , the maker of servers used in artificial-intelligence technology said an investigation found no evidence of misconduct by its management or by the company's board. The warrants said there was reason to believe Netanyahu and former Defense Minister Yoav Gallant have used “starvation as a method of warfare” by restricting humanitarian aid and have intentionally targeted civilians in Israel’s campaign against Hamas in Gaza — charges Israeli officials deny. The action by the International Criminal Court came as the death toll from Israel’s campaign in Gaza passed 44,000 people, according to local health authorities, who say more than half of those killed were women and children. Their count does not differentiate between civilians and combatants. Experts say hunger has become widespread across Gaza and may have reached famine levels in the north of the territory, which is under siege by Israeli troops. Israel says it has been working hard to improve entry of aid, though the trickle of supplies into Gaza remains near the lowest levels of the war. Netanyahu condemned the warrant against him, saying Israel “rejects with disgust the absurd and false actions” by the court. In a statement released by his office, he said: “There is nothing more just than the war that Israel has been waging in Gaza.” Gallant, in a statement, said the decision "sets a dangerous precedent against the right to self-defense and moral warfare and encourages murderous terrorism.” The warrant marked the first time that a sitting leader of a major Western ally has been accused of war crimes and crimes against humanity by a global court of justice. The decision turns Netanyahu and the others into internationally wanted suspects, putting them at risk of arrest when they travel abroad and potentially further isolating them . Israel and its top ally, the United States, are not members of the court. But others of Israel's allies, including some of its close European friends, are put in an awkward position. Several, including France, welcomed the court's decision and signaled they might arrest Netanyahu if he visited. White House press secretary Karine Jean-Pierre said President Joe Biden's administration was “deeply concerned by the prosecutor’s rush to seek arrest warrants and the troubling process errors that led to this decision.” The warrants represent "the most dramatic step yet in the court’s involvement in the conflict between Israel and Hamas," said Anthony Dworkin, senior policy fellow at the European Council on Foreign Relations. Israeli leaders, politicians and officials across the spectrum denounced the warrants and the ICC. The new defense minister, Israel Katz, who replaced Gallant earlier this month, said Thursday’s decision is “a moral disgrace, entirely tainted by antisemitism, and drags the international judicial system to an unprecedented low.” Human rights groups applauded the move. The warrants against both sides “break through the perception that certain individuals are beyond the reach of the law,” the associate international justice director at Human Rights Watch, Balkees Jarrah, said in a statement. The court issued a warrant for Mohammed Deif, head of Hamas’ armed wing, over the Oct. 7, 2023, attacks that triggered Israel’s offensive in Gaza. It said it found reasonable grounds to believe Deif was involved in murder, rape, torture and the taking of hostages amounting to war crimes and crimes against humanity. In the Hamas-led attack, militants stormed into southern Israel, killing 1,200 people — mostly civilians — and taking some 250 others hostage. Around 100 Israelis remain captive in Gaza, around a third of them believed to be dead. Khan withdrew requests for warrants for two other senior Hamas figures, Yahya Sinwar and Ismail Haniyeh , who have both since been killed. Israel says it also killed Deif in an airstrike, but Hamas has never confirmed his death. The warrants for Netanyahu and Gallant were issued by a three-judge panel in a unanimous decision. The panel said there were reasonable grounds to believe that both men bear responsibility for the war crime of starvation and the crimes against humanity of murder, persecution and other inhumane acts. The judges said the lack of food, water, electricity, fuel and specific medical supplies created conditions “calculated to bring about the destruction of part of the civilian population in Gaza,” including the deaths of children due to malnutrition and dehydration. They also found that by preventing hospital supplies and medicine from getting into Gaza, doctors were forced to operate, including performing amputations, without anesthesia or with unsafe means of sedation that led to “great suffering.” Israeli diplomatic officials said the government is lobbying the international community to speak out against the warrants and is considering an appeal to the court. The officials spoke on condition of anonymity pending a formal decision on how the government will proceed. Despite the warrants, none of the suspects is likely to face judges in The Hague anytime soon. Member countries are required to detain suspects facing a warrant if they set foot on their soil, but the court has no way to enforce that. For example, Russian President Vladimir Putin, wanted on an ICC warrant for alleged war crimes in Ukraine, recently visited Mongolia, a member state in the court but also a Russian ally. He was not arrested. Still, the threat of arrest now complicates any travel abroad by Netanyahu and Gallant. EU foreign policy chief Josep Borrell said the warrants are binding on all 27 members countries of the European Union. France signaled it could arrest Netanyahu if he came to its territory. Foreign Ministry spokesman Christophe Lemoine called it a “complex legal issue” but said France supports the court’s actions. “Combating impunity is our priority,” he said. “Our response will align with these principles.” Hamas in a statement welcomed the warrants against Netanyahu and Gallant but made no mention of the one against Deif. Israel’s opposition leaders fiercely criticized the ICC’s move. Benny Gantz, a retired general and political rival to Netanyahu, said it showed “moral blindness” and was a “shameful stain of historic proportion that will never be forgotten.” Israel’s campaign has caused heavy destruction across Gaza and driven almost the entire population of 2.3 million people from their homes, leaving most dependent on aid to survive. Two days after Hamas’ attack on southern Israel, Gallant announced a total seal on Gaza, vowing not to let in food, fuel or other supplies. Under U.S. pressure, Israel began allowing a trickle of humanitarian aid to enter a few weeks later. Israel now says it puts no limit on the supplies permitted into Gaza, and it blames the U.N. distribution system. But Israel's official figures show the amount of aid it has let in has plunged since the beginning of October. The U.N has blamed Israeli military restrictions, along with widespread lawlessness that has led to theft of aid shipments. The case at the ICC is separate from another legal battle Israel is waging at the top U.N. court, the International Court of Justice, in which South Africa accuses Israel of genocide , an allegation Israeli leaders staunchly deny. Now lawmakers want to ban them Citing text messages, travel receipts, online payments and testimony, the bipartisan committee paints a picture of a lifestyle in which Gaetz and others connected with younger women for drug-fueled parties, events or trips, with the expectation the women would be paid for their participation. The former congressman, who filed a last-minute lawsuit to try to block the report’s release on Monday, slammed the committee’s findings. Gaetz has denied any wrongdoing and has insisted he never had sex with a minor. And a Justice Department investigation into the allegations ended without any criminal charges filed against him. “Giving funds to someone you are dating — that they didn’t ask for — and that isn’t ‘charged’ for sex is now prostitution?!?” Gaetz wrote in one post on Monday. “There is a reason they did this to me in a Christmas Eve-Eve report and not in a courtroom of any kind where I could present evidence and challenge witnesses.” Here’s a look at some of the committee’s key findings: ‘Sex-for-money arrangements,’ drug-fueled parties and trips The committee found that between 2017 and 2020, Gaetz paid tens of thousands of dollars to women “likely in connection with sexual activity and/or drug use.” He paid the women using through online services such as PayPal, Venmo, and CashApp and with cash or check, the committee said. The committee said it found evidence that Gaetz understood the “transactional nature” of his relationships with the women. The report points to one text exchange in which Gaetz balked at a woman’s request that he send her money, “claiming she only gave him a ‘drive by.’” Women interviewed by the committee said there was a “general expectation of sex,” the report said. One woman who received more than $5,000 from Gaetz between 2018 and 2019 said that “99 percent of the time” that when she hung out with Gaetz “there was sex involved.” However, Gaetz was in a long-term relationship with one of the women he paid, so “some of the payments may have been of a legitimate nature,” the committee said. Text messages obtained by the committee also show that Gaetz would ask the women to bring drugs to their “rendezvous,” the report said. While most of his encounters with the women were in Florida, the committee said Gaetz also traveled “on several occasions” with women whom he paid for sex. The report includes text message exchanges in which Gaetz appears to be inviting various women to events, getaways or parties, and arranging airplane travel and lodging. Gaetz associate Joel Greenberg, who pleaded guilty to sex trafficking charges in 2021, initially connected with women through an online service. In one text with a 20-year-old woman, Greenberg suggested if she has a friend, the four of them could meet up. The woman responded that she usually does “$400 per meet.” Greenberg replied: “He understands the deal,” along with a smiley face emoji. Greenberg asks if they are old enough to drink alcohol, and sent the woman a picture of Gaetz. The woman responded that her friend found him “really cute.” “Well, he’s down here for only for the day, we work hard and play hard,” Greenberg replied. ‘Substantial evidence’ indicates that Gaetz had sex with underage girl, the committee said The report details a party in July 2017 in which Gaetz is accused of having sex with “multiple women, including the 17-year-old, for which they were paid.” The committee pointed to “credible testimony” from the now-woman herself as well as “multiple individuals” who corroborated the allegation. The then-17-year-old — who had just completed her junior year in high school — told the committee that Gaetz paid her $400 in cash that night, “which she understood to be payment for sex,” according to the report. The woman acknowledged that she had taken ecstasy the night of the party, but told the committee that she was “certain” of her sexual encounters with the then-congressman. There’s no evidence that Gaetz knew she was a minor when he had sex with her, the committee said. The woman told the committee she didn’t tell Gaetz she was under 18 at the time and that he didn’t how old she was. Rather, the committee said Gaetz learned she was a minor more than a month after the party. But he stayed in touch with her after that and met up with her for “commercial sex” again less than six months after she turned 18, according to the committee. Gaetz said evidence would ‘exonerate’ him but provided none of it In sum, the committee said it authorized 29 subpoenas for documents and testimony, reviewed nearly 14,000 documents and contacted more than two dozen witnesses. But when the committee subpoenaed Gaetz for his testimony, he failed to comply. “Gaetz pointed to evidence that would ‘exonerate’ him yet failed to produce any such materials,” the committee said. Gaetz “continuously sought to deflect, deter, or mislead the Committee in order to prevent his actions from being exposed.” The report details a months-long process that dragged into a year as it sought information from Gaetz that he decried as “nosey” and a “weaponization” of government against him. In one notable exchange, investigators were seeking information about the expenses for a 2018 get-away with multiple women to the Bahamas. Gaetz ultimately offered up his plane ticket receipt “to” the destination, but declined to share his return “from” the Bahamas. The report said his return on a private plane and other expenses paid by an associate were in violation of House gift rules. In another Gaetz told the committee he would “welcome” the opportunity to respond to written questions. Yet, after it sent a list of 16 questions, Gaetz said publicly he would “no longer” voluntarily cooperate. He called the investigation “frivolous,” adding: “Every investigation into me ends the same way: my exoneration.” The report said that while Gaetz’s obstruction of the investigation does not rise to a criminal violation it is inconsistent with the requirement that all members of Congress “act in a manner that reflects creditably upon the House.” Justice Department didn’t cooperate with the committee The committee began its review of Gaetz in April 2021 and deferred its work in response to a Justice Department request. It renewed its work shortly after Gaetz announced that the Justice Department had ended a sex trafficking investigation without filing any charges against him.
